General Order Terms

It is our intention that anyone who places an order for a DVD or CD recording, printed materials and/or other merchandise should receive it within 15 working days (world-wide). If you have not received your order within 15 working days, please contact us.

All prices on the UK site are in UK pounds and US Dollars. You will have a choice of making payment in either US dollars, UK pounds or Euros. If you hold a card in another currency, currency conversion will be made by your credit card company at prevailing rates of exchange.

It is illegal to make copies of any of ELITA Live or ELITA Live products or run them on a network without a license. Be aware that we may prosecute you if you do so.

DVD, CD and MP3 discs are licensed for personal use only. If you would like information on network licenses or site license for schools or businesses, please get in touch with us.

It is important that you read and comply with the software license agreement which comes with the disc you order.

ELITA Live have no liability whatsoever for products that are not delivered, arrive faulty or otherwise for not fulfilling your order, where these problems are caused by third parties. This does not affect your statutory rights. Any problems or complaints should be addressed to ELITA Live.

Returns and Cancellations

DVD Recordings:

You may return your product under our money back guarantee. We retain 25% of your original purchase to recover our shipping, re-packaging, credit card payment, and administrative costs.

When returning CDs under our money back guarantee, you must ensure you do the following:

Return the item so that it arrives on or before the expiry date. In the case of courier or special deliveries, 30 days will be deemed to have started when the item is delivered. When delivered by post, 30 days will commence one working day after the item was posted.

Please get a proof of postage certificate. We can only settle disputes when this has been provided.

Ensure that the item is in a condition fit for resale. Packaging will be complete and intact and in excellent condition; all discs will be present; discs will be free from any marks or scratches on either side.

Enclose a copy of your email confirmation of purchase and your address so that we may track your order and refund your credit card.

Please provide a written explanation for returning the course. Your feedback is valuable and required to complete the refund.

Whilst we will abide by the spirit of the guarantee, in the event of a dispute over timing or condition, our decision is final. You accept this contract on that basis.

Please note: this returns guarantee DOES NOT apply to week 1 only version of the programme, and a 25% administration fee will be retained for MP3 versions. Refunds will be made within 30 days of receipt of your returned goods.

Online Sessions:

We accept cancellations up to 24 hours before the lecture starts, giving a 100% refund. Cancellations should be in writing and sent to customer.service@elitalive.com or fax +44 8456 522 552

No refunds can be given after 24-hour deadline.

We will refund full cost of the session if:

• The session is cancelled due to presenter’s inability to attend
• The session is cancelled or terminated due to our technical fault

If you make reasonable attempts to attend the scheduled online session but unable to do so due to technical difficulties at your side, (e.g. loss of internet connection), we will offer you an opportunity either to take the session at another convenient date or to receive a recorded version of the lecture free of charge. We will not refund the cost of the session.

Security

In accordance with the requirements of the Data Protection Act 1998 we keep secure records which contain personal information about you. No data transmitted via the Internet can be guaranteed to be completely secure during transmission. We cannot ensure or warrant the security of any information you transmit to us whether by email or otherwise before we receive it. Please note that in accordance with our security procedures we may also request proof of your identity before disclosing certain information to you.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent
